He could still be a Chiefs player.
Taylor Swift and Travis Kelce may be prohibited from talking about their marriage under a prenuptial non-disclosure agreement, but the pop star may still have the right to sing about their relationship.
Attorney Sarah Luette, a partner in Blank Rome’s Marriage and Family Law Group, spoke exclusively to Page Six about what a potential prenuptial agreement between Swift and Kelsey could look like.
“Swift and Kelce may wish to include terms that promote confidentiality and privacy,” Reut, who does not represent the parties, told us. “This may include non-disparagement or non-disclosure terms regarding their relationship.”
However, Louette explained that there are “some exceptions” to the enforceability of these provisions under the law.
“In Taylor’s case, she probably wouldn’t want to include a clause restricting her from singing about her relationships in her songs, especially since there’s always so much speculation about the subject matter of her songwriting,” Luett said.
Swift is known for singing about ex-lovers and partners in her music, including several songs about Kelsey on 2025’s The Life of a Showgirl, and harsh lyrics about former lovers Joe Alwyn and Matt Healy on 2024’s The Tortured Poets Society.
Similarly, Legal Wasi shared that celebrities often want to limit and clarify what constitutes community/marital property in order to “avoid future claims on their creative works.”
“Especially when it comes to sequels and previous projects,” she said. “For example, if Taylor re-recorded one of her albums during their marriage, there would be an argument that the re-recording was, in part, marital property.”
An NDA in a prenuptial agreement would also prevent the singer and the Kansas City Chiefs star from disclosing the terms of the agreement to anyone other than their respective legal representatives and accountants involved in conducting the prenuptial agreement or potential dissolution proceedings.
“Similarly, the terms could include provisions requiring mediation or, in states where it is allowed, using a private judge for dissolution proceedings,” Luette said, adding, “For a high-profile couple like Swift and Kelce, this type of privacy provision would be especially valuable in shielding the details of a potential conflict from public scrutiny.”
Swift, who has a much higher net worth than billionaire Grammy winner Kelsey, may be responsible for covering her own bills.
“When one party is worth significantly more than the other, prenuptial agreements often provide that the less well-off party pays all of the couple’s living expenses, while the less well-off party retains separate property,” Luett said.
Some agreements may also be structured so that the high-net-worth pleason gifts or converts a portion of his or her property into another property of the community or the other party.
This “allows each party to maintain their investments and assets for the duration of the marriage,” Luett said, noting that “the amount converted or gifted often increases over time to reflect the length of the marriage.”
In the case of this A-list couple, Luett said they likely won’t combine their assets when they get married.
“Given the complexity of their respective properties, and the effort Swift has taken to buy back her masters and protect her music catalog, it is likely that a prenuptial agreement will keep their properties completely separate, even if one of them makes efforts to increase the other’s assets during the marriage,” Luette said.
However, it is possible to include conditions for starting a joint business during the marriage.
“They only need to clarify ownership of jointly held assets on a case-by-case basis,” Luet explained.
Because the companies each own multiple properties in different states, the agreement could include a clause (known as a “choice of law clause”) specifying which jurisdiction’s laws will be interpreted and enforced in the event of a future dispute.
Swift has homes in New York, Rhode Island, Tennessee, and Los Angeles, while Kelce has homes in Leawood, Kansas, Missouri, and Florida.
The NFL player proposed to Swift in August 2025 after two years of dating. A source told Page Six that the two plan to get married this summer in New York City.
