Robert Cosby Jr.’s wife, Alexiana Smokov, has filed for divorce as her husband is in prison in a recent lawsuit.
Smokov filed the paperwork Monday after secretly marrying the 22-year-old son of “Real Housewives of Salt Lake City” star Mary Cosby in 2022.
According to People, Smokov’s petition asks that both parties not “disturb the peace, harass, or threaten the other party by any means, including electronic means.”
The petition goes on to prohibit “violence or abuse against the other party or children; using the other party’s name, likeness, image, or identification to gain credit; opening or receiving an account for services; canceling or interfering with telephone, utility, or other services used by the other party; (and) canceling, modifying, or terminating (or) changing recipients.”
The petition also prohibits either party from terminating “health insurance, homeowners or renters insurance, auto insurance, or life insurance policies.”
Robert was arrested on Nov. 9 and charged with violating a pretrial protection order, trespassing, damage or destruction of property, assault on a uniformed peace officer or military member, and failure to comply with orders of law enforcement.
He remains incarcerated at the Salt Lake County Metro Jail, Page Six confirmed.
“Robert was slow to realize that his marriage was over,” his lawyer told People on Wednesday.
“He continued to communicate with his ex-wife in an effort to reconcile. He now recognizes that this relationship has come to an end and he must move on.”
The lawyer also said during Tuesday’s court hearing that Robert “takes responsibility for the mistakes he made and the pain he caused his ex-wife and her family.”
Representatives for Robert and his mother did not immediately respond to Page Six’s requests for comment.
Robert was previously arrested in September for allegedly trying to enter his stepfather’s home through a dog door. He also reportedly assaulted someone on the front lawn and failed to comply with police response.
He was charged with trespassing, assault, failure to comply with a law enforcement order and three counts of violating a court order.
“It was for his benefit,” Mary, 52, told People after her arrest in September. “I think he needed that. He’s never been through anything like that. He’s never experienced anything like that.”
The Bravolebrity admitted that she was “hurt,” “devastated,” “worried” and “scared” at first, but eventually accepted that “things happen for a reason, to show you the path you’re on.”
She added, “I feel like he needed it and he understands that it’s the wrong journey.”
On a November 2024 episode of “RHOSLC” Season 5, Robert, who pleaded guilty to DUI in 2022, confessed to Mary that he was struggling with drug and alcohol addiction.
He eventually sought treatment, just like Smokov. However, Robert once again found himself in trouble with the law after allegedly failing to prove he had completed his court-ordered stay at a rehab facility.
