Christina Ricci’s ex-husband James Heerdegen has been denied emergency custody of their minor son Freddie.
A former film producer filed for an emergency order to gain custody after his 11-year-old sent a text message to his father claiming the “Casper” actress had been drinking on a June 16 flight to Canada, according to court records obtained by Page Six.
During the flight, “Mr. Ricci allegedly consumed alcohol,” according to court documents. Freddy then texted his father, telling him that his mother had been drinking and that the child “used specific words to describe Mr. Rich’s drinking and described Mr. Rich’s subsequent actions.”
Two days later, Freddie’s lawyer told him about the texts. However, the preschooler claimed he “overreacted” when texting Herdegen.
The child also said “the description of Mr. Rich’s drinking and subsequent behavior differed from what he had described to his father,” the document said.
“I had no qualms about continuing to have Mr. Rich’s primary custody,” Freddie told his lawyer.
Rich, 46, requested that the text messages his son sent to his father be sealed. The Addams Family star claimed Freddie was bullied at school and could be bullied again if the papers are unsealed.
Rich believes further bullying “could put” her son’s mental health at risk.
The court agreed, sealed the messages and also denied Herdegen’s emergency custody order.
Page Six reached out to Rich’s attorney for comment, but did not immediately receive a response.
The former couple married in 2013 and welcomed Freddie the following year.
Rich filed for divorce in 2020, and the divorce was finalized in December of the following year.
The Sleepy Hollow actress is also mom to four-year-old daughter Cleopatra with her current husband Mark Hampton. She and the hairdresser got married in October 2021.
