Kim Zolciak has once again lost custody of her children. This comes in the wake of allegations that he “neglected” ex-Kroy Biermann’s four minor children.
According to TMZ, a judge temporarily stripped the “Real Housewives of Atlanta” alum of primary custody after Biermann filed an emergency motion on the matter last week.
The newspaper reported that Zolciak, 47, will now be restricted from spending time with her minor children every other weekend.
The ex-couple will continue to share joint legal custody of their children, but Biermann will reportedly be the final arbiter regarding education, non-emergency medical care, and religious matters.
However, Zolciak clarified that the judge’s decision to strip her of primary custody will only last until she and the retired former NFL star return to court for a hearing later this month.
“The judge’s decision is interim until his retrial on May 21st, when he will have the opportunity for a full hearing,” the Bravo veteran told TMZ in a statement Friday.
“I want more than anything for this process to be over for the sake of my children, but I look forward to the court date on May 21st when I will finally have the opportunity to tell the truth,” she added.
Representatives for Zolciak did not respond to Page Six’s request for comment.
According to TMZ, Biermann, 40, filed an emergency motion on April 22 seeking permanent physical and legal custody of her and the former RHOA star’s four minor children.
The couple, who have been in the process of divorcing since May 2023, have sons Kroy Jr., 14, Kash, 13, and 12-year-old twins Kaia and Kane. Biermann also adopted Zolciak’s two daughters, Brielle, 29, and Ariana, 24, before they married in 2011.
In addition to accusing Bravolebrities of negligence, Biermann reportedly claimed in an emergency motion that Zolciak is “performing acts that are harmful to children and contrary to the best interests of children.”
“(Zolciak) is selfishly concerned with his own image and career options over professional opinion and the best interests of his children,” the former Atlanta Falcon player wrote. “This amounts to neglect of minor children and is detrimental to the progress and healing of the family unit.”
Meanwhile, the former footballer’s estranged wife’s lawyer has slammed the former footballer’s neglect allegations as “unwarranted”.
“(Biermann’s) decision to file this motion lacks factual support and is unwarranted,” Zolciak’s attorney told TMZ last week. “We will address these allegations in the appropriate legal forum and vigorously defend the truth in court, not in public debate.”
This latest development in Zolciak and Biermann’s ugly custody battle also comes after the retired linebacker requested sole custody of the children in March.
He cited Ms Zolciak’s “mismanagement of basic childcare responsibilities”, claiming she had been out of the country for several weeks, only used parenting time once between February 26 and March 29, and did not follow agreed treatment terms.
Zolciak was removed from custody until he completed four court-ordered parent therapy sessions.
