Darius McCrary was arrested Sunday near the U.S.-Mexico border in California on an out-of-state felony charge, Page Six confirmed.
The “Family Matters” star is currently being held in a San Diego jail and is not eligible for bail at this time.
The actor was taken into custody by the U.S. Border Patrol, and online booking information lists the case as a “fugitive arrest,” which applies to people wanted in other states.
His attorney told Page Six that he was issued a warrant out of Michigan for failure to appear in court for failure to pay child support.
She also claims her client was given “inadequate service” because court notices were sent to a post office box and she was given only three days to appear in court. She said McCrary didn’t check his post office box until the day after his court date because he was infected with the coronavirus at the time.
McCrary has been arrested in the past for failing to pay child support. He reportedly owed $52,788.04 as of March 12, 2019, and was reportedly taken into police custody in November 2023 on a felony charge of failure to pay child support.
He was reportedly first arrested in 2015 for failing to pay child support, and two years later told a judge that “I don’t make any money.”
Less than a year later, McCrary was accused of dislocating his then 2-year-old daughter’s arm. He denied the charges and claimed that his ex-wife, Tammy Browner, had fabricated the story.
The former couple had been married for three years. She filed for divorce in 2017.
An attorney for the former sitcom star said her client is not obligated to pay child support because the complaint comes from the mother of his oldest son, Zecheria, now 18 and in a trust fund.
“His son is in the trust fund and is the sole beneficiary, but his mother wants the money,” she claimed.
She said the actor was near the U.S.-Mexico border because he had “partnered with a real estate investor and developer in Tijuana, Mexico” to build a shelter for the homeless community in Tijuana, Mexico.
“Darius was on good behavior when he found out he had a felony warrant for failure to appear at the Mexican border,” she said.
The father of three, who also has two daughters, is scheduled to appear before a San Diego judge on Wednesday.
