Actor David Del Rio, who was escorted off the set of the film “Matlock” last fall, filed for arbitration against CBS Studios over his termination.
Del Rio played Billy Martinez on the show starring Kathy Bates. Del Rio’s character was removed from the show following sexual assault allegations against him.
His lawyer, Sean Hawley, said Wednesday that he has taken steps to “address false and misleading allegations that have caused significant professional and reputational harm.”
“At arbitration, Mr. Del Rio will present real-time text communications and evidence that directly contradicts previous public characterizations of the interactions at issue, evidence that was not adequately considered before the adverse employment action was taken,” Holley said. “Mr. Del Rio looks forward to resolving this matter through the appropriate courts and believes that a full examination of the evidence will establish the truth and restore his professional reputation.”
Del Rio’s employment contract requires him to take the matter to private arbitration instead of filing a public lawsuit.
Del Rio had already filmed seven episodes of the show’s second season when the allegations surfaced last October. The show referenced Billy’s sudden exit in last week’s midseason premiere when a human resources representative asked about Billy’s whereabouts.
Sarah, played by Leah Lewis, said: “I’m sick. I’m very sick. I’m vomiting.”
“And we’ll cover him,” Bates’ character adds.
Lewis vaguely hinted at her involvement in the situation when she posted a photo of herself on Instagram last fall, writing, “My mom is here. We are moving forward in love and strength. I’m going to be okay. Thank you to everyone for all kinds of support and care. Truly, we are moving forward in strength. Keyword, strength. Please take this as a lesson.”
Del Rio’s wife, Katherine, later posted (and deleted) a response saying, “Mom is here. We move forward with love and strength because of what Leah has done for our family. Thank you for the love and support!”
