“47RONIN” director Karl Rinsch was sentenced to 30 months in federal prison on Monday, receiving half of the government’s recommended sentence after Judge Jed Rakoff considered evidence of mental health issues from Keanu Reeves and other character witnesses.
In December, a jury found Mr. Rinsch guilty of wire fraud and money laundering after prosecutors proved he defrauded Netflix of about $11 million during production on the unfinished science fiction series “White Horse” (also known as “Conquest”). Rather than complete his ambitious project, Rinsch bet big on the cryptocurrency market and spent millions more on luxury goods.
“I made a mistake,” Rinsch told the judge inside a lower Manhattan courtroom before his sentencing. “This process forced me to confront things about myself that I had never fully understood.”
A change between Rinsch’s trial and sentencing that ultimately appears to have influenced Lakoff’s analysis was the introduction of evidence regarding the director’s mental health, which defense attorneys purposely omitted from the trial and redacted in documents viewed by the jury.
Defense barrister Daniel McGuinness said: “Karl is now facing mental health issues that he previously didn’t want to deal with,” adding that Rinsch was “under the care of a doctor” during filming, but the doctor “wasn’t doing what they were supposed to be doing.” In recent months, Rinsch has completed treatment and now “reports feeling better and seeing things more clearly,” McGuinness said.
Rakoff said during the trial that “there were no signs of psychosis or other mental illness,” but he pointed to some of Rinsch’s unusual decisions, such as buying five Rolls-Royces not in his name, as evidence of “a man with a manic mental state that goes beyond simple greed.”
Mr. Rakoff also noted several letters in which Mr. Rinsch was “described as a positive role model.” One of the letters was from Reeves, who became friends with Rinsch after appearing on “47 Ronin.” Reeves wrote that she participated in “efforts in 2019 to get Karl some level of support through intervention and professional mental health care,” but that Karl refused.
“In connection with this,” Reeves continued, “we believe a situation arose in which his mental health was impaired by substance misuse and perhaps other issues, which amplified his self-destructive and grandiose behavior and affected his relationships, work, and ability to complete his ‘conquests.'”
Prosecutors said they took those letters into account when recommending a 60-month sentence, adding that their request would have been “much higher” without the references to Rinsch’s positive character and other clean criminal history. The government said in its sentencing memo that the sentencing guidelines call for a sentence of nine to 11 years in prison, primarily because of the high amount of fraud.
Prosecutors also argued that Mr. Rinsch displayed a “repeated disregard for the law” by repeatedly asking for additional funding for Netflix, despite having access to “high-paying trust funds” and wealthy Hollywood friends who could have financially supported his ambitious science fiction projects. The government also claimed that Rinsch’s “willingness to destroy” the production of “White Horse” damaged the careers of many actors and staff who had hoped for the success of the series.
Before handing down his sentence, Rakoff reflected on the effectiveness of prison sentences in white-collar cases. “There is a lot of suggestion in the literature that prison can have a positive impact on white-collar offenders,” he said, questioning whether sentences longer than five years would have more meaningful outcomes than sentences lasting two or three years.
“Sentencing should be sufficient, but not more than necessary,” Lakoff concluded. “It’s so easy to say, ‘He did something wrong. Get rid of him for a long time!'” This is another human being, and all of his issues need to be considered as a human being. ”
In addition to serving 30 months in prison, Rakoff ordered Rinsch to pay approximately $11 million in restitution, participate in outpatient mental health treatment programs, and refrain from using “opiates or other similar substances.”
Michael Schaffler, who appeared in court on behalf of Netflix, called the case “unusual” and said the streamer would leave it to the court to determine a schedule for repaying the stolen funds. Mr. Rakoff acknowledged that it was unlikely that Netflix would recover the full amount of the compensation, and said there would probably be no way to repay the approximately $11 million that Mr. Rinsch owed.
“I would not recommend him to continue investing in cryptocurrencies,” Lakoff joked. “It’s just a gambling market.”
The judge gave Rinsch 60 days to appear in court and ordered him to be jailed on September 1.
“Mr. Rinsch is an extremely talented individual who will find ways to utilize his talents even after his release from prison,” the judge concluded. “But he had no reason to do so. He chose to do so and covered it up for years.”
