Shannen Doherty’s ex-husband Kurt Iswarienko is disputing the divorce settlement between him and the late actress.
Ishwarienko’s lawyers filed legal documents obtained by PEOPLE in Los Angeles Superior Court on January 14, nearly two months after her estate said Iswarienko had defaulted on several “financial obligations” and settlement terms.
Iswarienko, 51, claimed in the document that a divorce settlement signed by Doherty on July 12, 2024, the next day by Iswarienko, and finalized shortly before Doherty’s death on July 13, 2024, was filed in the wrong court. Therefore, it argued that the court lacked jurisdiction to enforce the terms of the contract.
They also argued that the divorce case should have ended when Doherty died after a years-long battle with cancer, and that no settlement should have even been submitted, according to legal documents.

This comes after Doherty’s attorney and Shannen Doherty Family Trust trustee Christopher Cortazzo argued in a Nov. 24 filing that Iswarienko still owes money as part of the divorce settlement.
It included a provision for Mr. Iswarienko to sell Mr. Doherty’s $1.5 million home in Texas and “divide the net proceeds equally with (her) estate.” However, the filing states that Mr. Iswarienko “refused to put the Dripping Springs home up for sale.”
The filing also claimed that Mr. Iswarienko, a photographer, would buy Mr. Dougherty’s stock in the Mooney M-20 plane for $100,000 and pay that amount to her estate within five business days of the sale. However, after the sale took place in August 2024, $50,274 was allegedly “unilaterally seized” from Doherty’s estate, which has yet to be paid.
Doherty’s lawyer pointed out that in addition to the money clause, Iswarienko “rejects the return of (Doherty’s) personal property,” including photographs, another provision of the divorce settlement.
Iswarienko argued in a Jan. 14 filing that Cortazzo never even filed the motion in the first place because he “failed to show that he had authority under the trust.”
Doherty filed for divorce from Iswarienko in 2023 after 11 years of marriage. Doherty’s attorney Leslie Sloan told PEOPLE in a statement at the time: “Divorce was the last thing Shanann wanted. Unfortunately, she felt she had no other choice.”

The actress then claimed in a December 2023 interview with PEOPLE that she found out that the photographer had been cheating on her while they were dating, just before undergoing brain surgery to remove a brain tumor.
“I got married after my marriage essentially ended and I found out my husband had been having an affair for two years,” she said on a podcast in 2023. “At the end of the day, I felt incredibly unloved by the person I was with for 14 years, the person I loved dearly.”
