Shannen Doherty’s estate has filed a new complaint alleging that her ex-husband Kurt Iswarienko failed to abide by several terms of their divorce.
On November 24, lawyers for Doherty, who died in July 2024 after a long battle with cancer, filed a petition for divorce from Isawalienko, which was finalized shortly before Doherty’s death.
Doherty signed the divorce settlement on July 12, the day before she died, and Iswarienko signed it on July 13, the day of her death, PEOPLE previously confirmed. In a new filing obtained by PEOPLE, Doherty’s attorney and Shannen Doherty Family Trust trustee Christopher Cortazzo allege that Isawarienko has defaulted on several “financial obligations” that are part of the divorce settlement.
Among the terms of the divorce settlement was that Ms. Iswarienko would sell Ms. Dougherty’s $1.5 million home in Texas and “divide the net proceeds equally with (her) property.” According to the filing, Iswarienko has refused to “put his Dripping Springs, Texas, home on the market.”
The home appears to be where Iswarienko lives, according to a Sept. 2 filing in which Iswarienko’s attorney Harley M. Gasmer withdrew from the case and listed the Dripping Springs home as his last known address.

The photographer also “refused to return (Doherty’s) personal property,” another clause in the divorce settlement.
According to the filing, Mr. Iswarienko also failed to “provide an inventory” of Mr. Doherty’s photos, which was required in the divorce settlement.
The settlement also specifies that the photographer will provide copies of all of Doherty’s photographs by September 1, 2024, a request that he is “currently 14 months overdue.”
The divorce settlement also stipulates that Mr. Iswarienko will buy out Ms. Doherty’s stock in the Mooney M-20 plane for $100,000 and pay that amount to her estate within five business days of the sale.
After the sale in August 2024, Doherty’s estate allegedly “unilaterally seized $50,274,” which has not yet been paid and is “15 months in arrears.”

The Charmed star filed for divorce from Iswarienko in 2023 after 11 years of marriage. “Divorce was the last thing Shanann wanted,” Doherty’s agent Leslie Sloan told PEOPLE in a statement at the time. “Unfortunately, she felt she had no other choice.”

She later claimed that he had been cheating on her during their relationship, but she only found out about it just before undergoing brain surgery to remove a brain tumor. “I got married after my marriage essentially ended and I found out that my husband had been having an affair for two years,” she said on a podcast in 2023.
“At the end of the day, I felt incredibly unloved by the person I was with for 14 years, the person I loved dearly.”
