Kim Zolciak revealed the issue of her custody battle after it was reported that she would not be allowed to see her and Kroy Biermann’s children again until treatment is complete.
On Friday, the reality star explained in a lengthy Instagram Story that she is “not losing custody” of her children (14-year-old Kroy Jr., 13-year-old Kash, and 12-year-old twins Kaia and Kayne) and that she has “not made any changes to the custody arrangement.”
“I signed a temporary protection order at the end of January,” Zolciak continued. “The order clearly states that both mother and father will attend counseling sessions twice a month for two months and once a month thereafter. I was out of the country from February 26th to March 28th due to contractual filming obligations for two separate productions.”
The “Real Housewives of Atlanta” alum added that she didn’t have any days off to attend counseling sessions.
“Today’s Kroy (who brought up KJ and Kash until 5 p.m. today) is raising the kids over spring break, which is the parenting time specified in her existing contract,” Zolciak, 47, revealed. “When the kids come home on Friday, I will resume parenting time. My counseling session is scheduled and will be completed next week.”
Before logging off, the mother of six revealed that she had not been stripped of her parental rights.
“For the avoidance of doubt, I have not lost custody of my children and no changes have been made to the custody arrangements other than the agreed temporary order,” she wrote.
Zolciak also reposted TMZ’s original report, writing below the photo, “I will never put up with these lies anymore.”
Zolciak’s Friday statement came shortly after TMZ obtained court records showing that the ex-girlfriend’s four minor children will live with Biermann, 40, starting April 3 until the Bravo star completes four mandatory parent therapy sessions.
According to the court order, the earliest Zolciak can be reunited with his children is April 13.
Just days earlier, Biermann had requested sole custody of her two children, citing her ex-husband’s “mismanagement of basic childcare responsibilities.”
According to court records obtained by TMZ on Monday, the retired athlete asked a judge to modify the joint custody arrangement.
According to the outlet, Biermann also claimed that the “Tardy for the Party” singer had been out of the country for several weeks.
He reportedly argued that “the facts surrounding[Zolciak’s]misparenting of the children, lack thereof, and blatant mismanagement of basic parenting responsibilities are virtually unbelievable to anyone unaware of the circumstances.”
Biermann later accused the reality star of “fraud and deceit” in agreeing to the current joint custody agreement, and claimed that Zolciak took advantage of her parenting time only once, from February 26 to March 29.
According to the former NFL star’s complaint, one of the children was bitten by a dog while in Zolciak’s care on March 9.
In a statement to Page Six, the “Surreal Life” alum slammed his ex-girlfriend’s demands, saying, “These accusations are completely false and nothing more than a deliberate attempt by Kroy to smear my character. I worked on two television shows five weeks apart to support my family and ensure my children were taken care of. I can never apologize for this.”
He added, “I refuse to be bullied or have lies twisted into a narrative about who I am. I will not be silent. The truth is on my side and will always come out, no matter how much someone tries to hide it.”
Meanwhile, Zolciak and Biermann’s messy legal battle began two years ago, with the linebacker filing for sole custody of the child in August 2025.
In her filing, Ms. Biermann reportedly accused Ms. Zolciak of subjecting her children to “emotional and psychological abuse” and claimed that her ex-husband repeatedly left them alone without “appropriate parental guidance.”
The ex-girlfriend first filed for divorce in May 2023 after 11 years of marriage.
Despite a brief flare-up – Biermann had adopted two daughters, Brielle, 29, and Ariana, 24, from Zolciak’s previous relationship – the relationship flared up in August 2023.
Zolciak and Biermann continued to live together in a mansion in Georgia after their separation in 2023, but they were forced to vacate the property in April 2025, which was seized by federal marshals.
