Matt Kalil drags Pamela Anderson sex tape into court argument over Haley Bailey’s penis comment

Matt Kalil referenced Pamela Anderson’s sex tape in his invasion of privacy and unjust enrichment claims against ex-wife Haley Bailey.

In recent court documents obtained by Page Six, Khalil filed a motion opposing Bailey’s request to dismiss the case after Bailey made comments about his large penis.

In his lawsuit, the NFL star explained how courts have “recognized and protected individuals’ interests in protecting their intimate personal facts.”

“Especially when it comes to private and intimate details such as nudity and sex, courts like the Lake Minnesota Supreme Court have time and again protected public disclosure of such information,” court documents say.

Khalil tried to make his point by referencing Bret Michaels and Pamela Anderson’s legal dispute over a 1993 sex tape. The former couple is photographed at a Playboy party in Los Angeles, California in September 1994. Ron Davis

Khalil, 36, then cited Anderson and Michaels’ legal dispute over a 1993 sex tape as an example.

He explained how Michaels and Anderson tried to stop an adult film distributor from releasing the sex tape.

“The court noted that ‘sexual relations are among the most personal and intimate acts,'” he explained. “Although[Anderson]appeared nude in magazines, movies, and publicly distributed videotapes, she was a professional actor who played roles that involved sex and sex appeal. However, the fact that she played roles that involved sex did not mean that her true sex life was exposed to the public.”

“Nor did the fact that[Anderson]appeared in another publicly distributed sex tape with another rock star sway the court, because it was not prepared to conclude that ‘public disclosure of one sexual encounter permanently deprives an individual of his or her privacy interests in all subsequent and preceding sexual encounters.'”

The court found that Michaels had a “privacy interest in his own sex life.”

“Courts across jurisdictions have recognized that there are facts so intimate and personal that it would not be in the public interest to publicly disclose them, even when it concerns individuals whose private lives may have less protection because they are public figures,” he argued.

Bailey fired back in court papers filed Wednesday, arguing that the privacy claim was a “failure” because the speech was “constitutionally protected.”

Kalil’s attorney, Ryan Saba, told Page Six, “Haley Kalil revealed personal and intimate details about Matt Kalil that are of no legitimate public interest, exposing Matt Kalil and his family to widespread ridicule and unwanted attention.” “Haley Kalil shared these sensitive personal information about her ex-husband in an apparent pursuit of wealth and fame. Her actions were extreme and outrageous, beyond the bounds of common sense, and caused significant harm to society.” Matt Kalil, his family, and his business. ”

“Haley Kalil’s motion to dismiss does not dispute the fact that she improperly disclosed private and intimate details about Matt Kalil, resulting in widespread ridicule and unwanted attention. This motion completely misses the point that a spouse has no right to reveal private and confidential marital and sexual details for profit. We look forward to the motion being dismissed in its entirety.”

A representative for Mr. Khalil did not respond to Page Six’s request for comment.

The drama began when Bayley, 33, claimed on a Twitch stream in November 2025 that her divorce from Khalil was due to the size of his penis.

“We were trying to make it (our marriage) work,” she said.

“Fuck you…fuck you our entire marriage,” the model continued. “But I was willing to try everything. I tried all the therapists, I tried all the doctors. I’m not going to lie… I looked up the lipotype ST… So it’s kind of funny. My life is like a comedy, it kind of writes itself. That was the biggest factor.”

The model compared the size of Khalil’s penis to “two Coke cans stacked on top of each other, maybe a third.”

She concluded: “We tried, but it’s not possible unless you shed a tear.”

Khalil filed a lawsuit against his ex-wife in January over her claims.

In a court filing obtained by Page Six, he claimed that her “degrading and highly personal comments” caused “unwanted public attention and invasive comments.”

“Defendant shared sensitive personal information about Plaintiff for the entertainment of her viewers and for her own financial benefit, even though Plaintiff reasonably expected it to remain private,” the complaint states.

“Defendant’s choice to discuss such a personal matter that is not of legitimate public concern was extreme, outrageous, and beyond the bounds of common sense.”

He is seeking $75,000, claiming he has suffered “severe emotional distress, humiliation, reputational damage, and emotional distress.”

In response to the first motion, Mr. Bailey requested that the case be dismissed.

“Plaintiff’s complaint alleges civil liability against a woman in the public eye for providing a truthful autobiographical account of the sexual trauma she suffered that led to the end of her celebrity marriage to a well-known NFL football star,” court documents say.

Khalil and Bailey married in 2015 and divorced in 2022. He is currently married to his wife Keilani Asmus.
