Robert Cosby Jr. was charged with domestic violence and had a warrant out for his arrest in the weeks leading up to his tragic death.
Mary Cosby’s 23-year-old son was charged with Felony Aggravated Assault and Felony Assault on February 5, two days after being released.
According to documents obtained by TMZ on Thursday, the alleged victim called Robert Jr. on Nov. 23, claiming he became enraged after she dumped drugs in the toilet six months earlier.
The alleged victim’s name has not been released, but his initials related to the incident are AS and he referred to Robert Jr. as “husband.”
Robert Jr., who has spoken openly about his struggle with drugs, finalized his divorce from his wife of three years, Alexiana Smokov, in January.
According to the paper, the victim claimed that he “punched her in the face and head and kicked her in the stomach.”
Mr AS also claimed that he was suffocated for several seconds and could not breathe.
The victim showed officers scars from the alleged encounter, including a “red and swollen” eye, a lump on his eyebrow and marks on his neck.
According to TMZ, Robert Jr. will receive harsher penalties for his previous domestic violence crimes.
Additionally, Mary provided evidence and was listed as a witness in the police report.
The Salt Lake City Police Department did not immediately respond to Page Six for comment.
Robert Jr. was released after serving two months in prison for allegedly violating Alexiana’s restraining order, just two days before he was charged. He pleaded guilty to the charges against him in November.
In a statement to People magazine, his attorney said he “expressed deep regret for his past actions and acknowledged that his past actions demonstrated a lack of judgment.”
The “Real Housewives of Salt Lake City” star’s son was found dead on Feb. 23 after officers “responded to an overdose call that turned into a death investigation.”
Mary addressed Robert Jr.’s death shortly after news of his death broke on Wednesday, writing on Instagram that she knows “he is finally at peace.”
“Our beloved son Robert Jr. has been called to be with the Lord,” she said. “Our hearts are broken, but we take comfort in God’s promises and knowing that He is finally at peace. We appreciate your prayers and your trust in the Lord to carry us through this time of sadness.”
