Kandi Burruss’ estranged husband Todd Tucker is demanding primary custody of their two children and questioning prenup in the divorce.
On November 26, the businessman reportedly filed a response to his estranged wife’s divorce petition.
In documents obtained by Us Weekly, Tucker, 52, claimed that the Xscape singer’s two children, son Ace, 9, and daughter Blaze, 6, are now living with her in Georgia because Burruss tends to “work out of state.”
The former “Real Housewives of Atlanta” husband said in a written statement that Burruss’ work obligations “require him to continue to be away from his children for at least the next few months.”
“The parties have been working together to resolve all issues, and (Tucker) remains committed to continuing negotiations in good faith,” Tucker’s filing said.
In his filing, Tucker said that if he and Burruss, 49, cannot reach a custody agreement, he will “seek primary physical custody, joint legal custody, and final decision-making authority.”
However, Ms. Tucker praised her ex-husband, saying, “He recognizes (Mr. Burruss) as a loving and capable parent, and it is his sincere hope that preliminary and ongoing discussions between the parties will fully resolve all issues.”
Additionally, the TTucker Productions LLC founder also mentioned the prenuptial agreement they signed prior to their April 2014 wedding.
According to Us Weekly, Tucker suggested she was pressured into signing a prenuptial agreement without proper legal representation.
Tucker’s attorney said in a statement that the agreement was “presented to (Tucker) without an attorney, even though (Burruss’) then-lawyer had previously communicated with (Tucker’s team) about the possibility of a prenuptial agreement.”
“Despite knowing this, (Mr. Burruss’) attorney submitted a final agreement to (Mr. Tucker) for signature shortly before the wedding, without any notice or consultation with (Mr. Tucker’s team), who were heavily involved in the negotiation process,” the filing said.
“These circumstances raise serious questions regarding the legal enforceability of the document in question. Nevertheless, (Tucker) remains committed to working in good faith to resolve this matter as amicably and privately as possible.”
Ms. Tucker also requests that she and Mr. Burruss “divide all marital assets, real and personal, tangible and intangible.”
If the prenuptial agreement is found to be invalid, Ms. Tucker is seeking primary physical custody, joint legal custody, and possibly alimony.
Page Six reached out to a representative for Burruss for comment, but did not immediately receive a response.
Last month, the Bravo alum announced that she and Tucker were divorcing after 11 years of marriage.
In a candid Amazon Live last week, Burruss revealed that the breakup had been “something that had been brewing for a while.”
Despite their divorce, the ex-lovers remain friendly and even reunited to celebrate their daughter’s sixth birthday and Thanksgiving.
Tucker is also the father of daughter Kaela Tucker, 29, with ex Keema Parker, while Burruss has daughter Riley, 23, with ex Russell Spencer.
