Hallmark star Mike Heslin died on a birthday trip to Las Vegas after restaurant staff were said to have blocked CPR in a medical emergency, the new lawsuit alleges.
Heslin’s husband, Scotty Dynamo, allegedly allowed staff at Javier’s at Aria Hotel to provide emergency care by allowing “avoidable tragedy” through multiple “failures.” According to documents obtained by Daily Mail.
Dynamo allegedly filed September 18th in the lawsuit, but the “Lio-Lion” actor “showed obvious signs of a medical emergency” while the restaurant staff “forced interfering” with a nearby diner who tried to carry out CPR and “forced interfering.”
Friends of Heslin also claimed in the document that they did not obtain an automatic external defibrillator (AED) in a medical emergency, despite the restaurant having one at the facility.
They also claimed that they were “forcedly removed” from the resort during the incident.
According to the lawsuit, restaurant staff have been accused of preventing other diners from helping Heslin, and his friend allegedly “arrests” for trying to provide assistance.
His companions also allegedly claim they tried to record the incident on their phone, but staff members allegedly “request” to remove the video according to the documentation.
The restaurant is being sued for five illegal deaths. Loss of the Consortium; Negligence; Employment, retention, training, and supervision of negligence. According to the Las Vegas Review Journal, gross negligence.
Heslin’s spouse argued that Heslin’s death was “a direct and proximity to the defendant’s actions and omissions,” and that he was seeking damages in excess of $30,000, funeral costs and punitive damages.
MGM Resorts International rejected the charges of the dynamo through a six-page statement Monday.
“These claims are not in line with the facts and will be addressed through legal proceedings,” the hospitality company said.
Dynamo did not immediately return a request for comment.
Dynamo lamented the loss of his “soulmate” in a heartbreaking Instagram post last July, writing that Heslin had died of “an unexpected cardiac arrest.” He was 35 years old.
“Michael is young, in perfect health, and the doctors have not explained what happened,” Dynamo wrote at the time, “When I felt you take your last breath, my heart was shattered to a million.
“If I had the power to exchange places with you, I’ll do it right away.”
