Britney Spears has been seen for the first time since her DUI arrest earlier this month, and her case is currently being heard by county prosecutors.
A spokesperson for the Ventura County District Attorney’s Office told the California Post, “The DUI case against Britney Spears has been submitted to the Ventura County District Attorney’s Office and is being reviewed by prosecutors.”
The statement continued: “Part of that review may include seeking additional information and evidence. A filing decision will be made prior to the scheduled court date of May 4, 2026.”
The 44-year-old pop star was spotted in Malibu, California, on Sunday, according to a photo posted by social media fan page BritneysVault. In the photo, Spears is wearing a long brown coat as she waits in line to order at Starbucks at the Malibu Country Mart.
Inside the store, Spears wore black sunglasses and had her long blonde hair down in waves. She had a cell phone in her left hand and a large orange bag.
The “Toxic” singer was handcuffed by the California Highway Patrol and arrested on March 4 in Ventura County on suspicion of driving under the influence. He was released the next morning.
Her arrest came months after she was seen driving erratically after a night out with friends.
Spears’ manager, Cade Hudson, called her arrest “inexcusable” in a statement to Page Six.
“This was a completely unacceptable and unfortunate incident. Britney intends to take the right steps and abide by the law. We hope this is the first step in the long-awaited changes that should occur in Britney’s life,” the statement read. “I hope she gets the help and support she needs during this difficult time.”
Referring to her sons, Sean Preston, 20, and Jayden James, 19, she added: “Her sons will be spending time with her. Her loved ones will be making long-awaited plans to help her succeed in her well-being.”
Jaden’s Mercedes, which Spears reportedly bought for him last year, was discovered at Jaden’s home the day after he was released from prison. A source close to the singer told Page Six that her sons support her after her run-in with the law.
“Her sons are with her now. They love her and want to support her and just want her to feel better,” the source said.
A source also said Spears was “devastated” by the arrest and that the encounter “scared her.”
“Britney knows she will have to face the consequences, whatever they may be,” they said, noting that her aides “hopefully this will be rehab rather than prison.”
“She knows that what happened was very bad and could affect not only her life, but those around her, especially her son,” they added.
“She really regrets what happened.”
Spears’ erratic behavior on social media in recent years has worried some fans.
In February, she lashed out at her family on Instagram, saying, “I was so incredibly lucky to be alive that for once in my life my family even treated me and now I’m scared for them.”
