Brian Littrell’s $50,000 lawsuit against a woman who claimed his private beach property was trespassed has been dismissed by a judge in Walton County, Florida.
A judge on Tuesday dismissed the lawsuit “without prejudice” for “failing to state a claim upon which relief could be granted,” according to court documents obtained by Page Six.
However, Brian and his wife, Regan Littrell, have 20 days to refile an amended complaint in the case.
Representatives for Brian and Regan did not immediately respond to Page Six’s request for comment.
The couple first filed legal action against Carolyn Barrington Hill on September 19, 2025, charging her with seven counts of trespassing, one count of invasion of privacy, and one count of stalking for incidents that occurred between April 2025 and September 6, 2025. However, the stalking charges were later dismissed.
They alleged in legal filings that Hill ignored a “no trespassing” sign on the Santa Rosa Beach property and entered the area “without right or authority.”
They alleged that Hill “attempted to antagonize, bully, and harass” them on “multiple” “unauthorized immigrations” beginning in April.
Brian and LeeAnne also claimed that Hill’s “trespass” interfered with their “use and enjoyment of the premises” and caused them “emotional distress.”
The judge’s order dismissed Littrell’s emotional claims because “emotional distress damages are not available in trespass claims.”
Brian and Regan also named BLB Beach Hut LLC as a plaintiff, and the judge said the company cannot experience emotional distress because it is a corporation, not an individual.
In one incident, the pair accused Hill of installing beach furniture on their property before he had a heated exchange with the property manager.
Hill began “screaming and swearing” after the property manager asked her to move her belongings, according to the complaint.
They also claimed she “videotaped” them without their “knowledge or consent” and “incited” other members of the public to participate in trespassing on her property.
In addition to Mr. Hill, the Littrells filed a lawsuit naming the Walton County Sheriff’s Office for failing to enforce their private property rights.
