What happens next for ‘freed’ Britney Spears after DUI arrest

Britney Spears’ life is spinning out of control again, with her car swerving erratically between lanes, much like her car before her arrest Wednesday night.

The 44-year-old “Womanizer” star was reportedly “crying and tearful” when she was arrested for drunk driving in Ventura County, California, adding to months of public anxiety over the singer’s well-being.

Sources close to Spears told Page Six that she had been ignoring her friends’ desperate need for help for some time. Officials said the arrest could land her in jail or a rehab facility, especially since a substance was found in her black BMW convertible and was sent to a lab for testing.

“Those around her are making plans. They want to admit her to a treatment center so she has time and space to get healthy and get back on track. It will be a medical detox,” a source told Page Six.

This comes after news that police found pills (believed to be Adderall, according to TMZ) in her car when she was pulled over.

“What she wants most is to go to jail,” the source said. “She is heartbroken by this whole situation, but she has no one to blame but herself, and she knows it.”

In fact, Spears’ own manager, Cade Hudson, echoed similar sentiments on Thursday, telling Page Six, “I hope this is the first step in the long overdue changes that need to happen in Britney’s life,” suggesting it may be time for her family to intervene.

“I hope she gets the help and support she needs during this difficult time,” Hudson added.

But Spears’ path became rocky when it came to involving her family in her problems. She entered into a conservatorship agreement in 2008, which means her every move is controlled by her father, Jamie Spears, and her lawyer.

That sentence was lifted by a Los Angeles court in 2021 after massive public outcry and an entire “Free Britney” movement.

The biggest fear for many is that Britney might go back into the conservatorship.

LaShawn Thomas, who previously litigated similar conservatorship cases with TV’s Wendy Williams, told Page Six that would be an extreme move.

She noted that the lawyer who removed Spears from the conservatorship is “playing a huge role in Britney’s current and future treatment.”

“Because of how difficult it was for her to get out of the conservatorship,[Britney]may not be amenable to judicial oversight at all.”

For court intervention to take place without Britney’s approval, Britney would have to prove she was in danger, and legal experts consulted by Page Six said DUI alone likely would not meet that criteria.

But with treatment, he may be able to avoid incarceration.

“Realistically, (Spears) could be required to attend a rehabilitation facility as part of a pretrial diversion program, or treatment could become a condition of probation if there is a conviction or plea to DUI or reckless driving charges,” Thomas said.

She also explained that there are a myriad of alternative treatment plans aside from conservatorship. Guardianships are usually reserved for worst-case scenarios in which people are unable to function fully on their own.

Spears has had a rough road with many of her closest relatives, but in her 2023 autobiography, The Woman in Me, she largely blames them for allowing her conservatorship to last so long.

Among those who have publicly criticized her are her father, mother Lynne Spears, and sister Jamie Lynn Spears.

In 2023, she divorced her third husband Sam Asghari after 14 months. Sources said she also laid off some of her staff.

In a statement noting the “long overdue changes that are to occur in Britney’s life,” Hudson also said that “her sons” – Spears’ sons with second husband Kevin Federline, Sean Preston, 20, and Jayden James, 19 – will also “spend time with Britney. Her loved ones will come up with a much-needed plan to help her succeed in her happiness.”

“Her sons are with her now. They love her and want to support her and just want her to feel better.”

“Right now everyone is waiting for the test results,” a source said regarding what was found in her car. “Britney knows that she will have to face the consequences, whatever they may be. But we can only hope that it will be rehabilitation and not prison.”

A source close to Spears’ ex-boyfriend Paul Soliz, whom she dated after her divorce from Asghari, told Page Six that Spears has been in touch.

“They’re not together. But they still talk on the phone. She just needs someone to vent to,” the source said of Soliz, adding that she also saw worrying signs about the star’s mental health while dating.

“When they lived together, they had arguments and fights. At one point he said she (Britney) needed help, and I could see that myself,” a source close to Soliz said. “Britney always needed help.”

This week, the California Post reported that police had been called to Spear’s Thousand Oaks residence 14 times in the past two years, including multiple welfare checks.

In October 2025, ex-husband Federline’s revealing memoir “You Thought You Spears’ sources told Page Six earlier this week that Federline entered a “downhill” spiral that ultimately led to her DUI arrest, which included allegations that Spears had often exhibited “erratic behavior” such as taking cocaine while breastfeeding her sons and standing at their sons’ door in the middle of the night with a knife.

“But the truth is this has been going on for a while,” the source added. “In recent months, her behavior has become increasingly erratic. She has gone from energetic to lethargic.”

She was then reportedly seen driving erratically in Los Angeles.

“The last few months have been extremely difficult,” a source close to Spears said. “The last thing she wants is to be judged in public again.”

But the public has already been saying a lot about Spears these days, with widespread concern sparked by a head-scratching social media video of her doing a jerky dance.

She posted just hours before her arrest. A week ago, she posted a post in which she appeared to be in pain after being swept off her feet by lacy lingerie.

A September 2025 video showed the floor of her Thousand Oaks mansion covered in dog feces. In 2023, she surprised fans by dancing with what looked like a knife, but later claimed it was “fake.”

On her 43rd birthday in December 2024, Spears posted a bizarre clip in which she claimed she was indeed “5 years old” and “has to go to kindergarten tomorrow.”

After her arrest, Spears or someone close to her deleted her Instagram profile.

Now, even her most loyal fans are having their hands wringed over the situation.

“It’s so sad to see that Britney wasn’t truly freed by the #FreeBritney movement,” Pilar Vigneault, who organized the #FreeBritney movement to free her from conservatorship, told Page Six.

Meanwhile, a source close to Spears told Page Six that she is not taking her actions lightly.

“She is devastated. This has scared her,” the person said. “She knows that what happened was very bad and could affect not only her life, but those around her, especially her sons. She is extremely remorseful for what happened.

“This is not about getting Britney back to work; this is about Britney living a full and healthy life with her sons and family.”
